Kelvin Koh comments in BT: “Ministry of Law seeks public feedback on IAA”

In a news article published in the 26 June 2019 edition of the Business Times on the Ministry of Law’s public consultation to seek views on proposals to amend the International Arbitration Act, Kelvin Koh said that the changes rationalise the current process in arbitration and addresses gaps in existing rules. They are also in line with developing Singapore as a dispute resolution hub.
While the rules provide more scope for judicial oversight due to the need to have a point of law decided by the courts – rather than an arbitrator who may be an expert in his commercial or professional field, but may not be a legal expert – it also gives the parties more control on whether they want the courts to have a say over the issues of law, he added.
