We are pleased to have successfully acted for the Singapore Medical Council in Lee Pheng Lip Ian v Chen Fun Gee and others and other matters [2019] SGHC 51.The matter was in relation to a bid made by Lee Pheng Lip, a doctor under investigation for offering non-mainstream medical services, to stop a disciplinary tribunal probe against him. He argued that he had suffered substantial prejudice from the “inordinate delay” it had taken for his case to be referred to the tribunal by a complaints committee. He applied for leave to quash all time extensions by the complaints panel chairman, the order that an inquiry be held by a disciplinary tribunal, and an order to stop the SMC referring the complaint. We successfully argued that the committee’s applications for time extensions to complete its inquiry were not open to a judicial review and could not be quashed. This matter can potentially make law in judicial review.
