In a High Court test case, TSMP’s Head of Litigation Melvin Chan and senior associate Darren Tan successfully argued that a Bangladeshi worker deployed as a site supervisor is not an executive and is entitled to pay rates for rest days he worked, as set out in Part IV of the Employment Act. The ruling sets precedent and prevents further workers from being shortchanged by unscrupulous employers changing their job title arbitrarily. The case was referred to us by our partner Transient Workers Count Too (TWC2).
