Before joining TSMP to establish the firm’s Korea desk, Mijung practiced as a partner at a top-tier law firm in Seoul.
Lauded by clients for her strong interpersonal and problem-solving skills, Mijung has a wealth of experience on a wide variety of legal and business issues, with a specialisation in Corporate, Merger & Acquisition and Commercial matters including contract review, general corporate matters, compliance programs, intellectual property law, and regulatory and competition law.
This includes all aspects of competition law, such as international cartel, merger control, abuse of dominance, sub-contracts, compliance and regulatory issues.
Mijung possesses an acute commercial sense, honed through the years from her extensive experience working with clients across diverse industries. Clients love her ability to find creative and practical solutions to their problems, not only from legal compliance perspective, but also in tune with their business and commercial needs, in a variety of challenging situations.
She has worked with a wide range of multinational companies, including Microsoft, Qualcomm, Samsung, LG and Hyundai-KIA group.
She also has a keen interest in ICT sectors, starting from her post-graduate, where she wrote a dissertation paper on digital market and big data, algorithms and competition law matters. She has been published on topics such as zero-rating and net-neutrality, big data issues.
Notable Briefs
Leading legal counsel for Qualcomm in the biggest case yet in Korean competition law history (fine of $854milion). KFTC ruled that Qualcomm, as one of the largest SEP holders in the cellular industry, abused its dominant position by refusing to grant licenses to chipset makers (Intel, Mediatek etc.) and forcing mobile manufacturers (such as Apple, Samsung, LGE, Huawei) unfair license terms against the FRAND principle. Participating as a one of the main legal professionals in litigation in the Appeal and Supreme Court. Dealt with numerous and extensive works related to economic, patent and competition law.
Represented as a leading legal counsel for Microsoft in the alleged bid rigging case in Korea. Successfully defended alleged infringement at hearings and obtained KFTC’s official decision stating that Microsoft is innocent and cartel agreement was not established.
Represented LG Electronics in a case relating to unfair trade practice. Having participated as a main representative from the administrative level to court appeal.
Represented Hyundai-KIA group, Samsung-corning in Antitrust case.
Advised Korean construction and Engineering companies such as Hyundai, Lotte and Kolon E&C.
Advised GE in respect of the establishment of a Joint Venture with French companies.
Advised Eggslut (U.S. food franchise company) and SPC (Korean leading food franchise company) in establishment of a subsidiary in the Asia region, drafting and reviewing business investment contract, franchise agreements and Information Disclosure Document, advising all relevant issues related to Franchise Act.
Advised Molekule (U.S. tech company based in San Francisco) in all legal matters related to the launch of new brand/products such as terms and conditions, commercial legal issues, privacy policy, distribution contract, consumer protection, advertisement and IP/competition law issues.
Advised Bosch Group/ Daerim automotive and reviewed numerous corporate general issues including purchasing/procurement agreement, non-disclosure agreement, distribution agreement, consignment warehouse agreement, claim compensation agreement, etc.
