Prof Tang Hang Wu was quoted in Lianhe Zaobao by Poh Lay Hoon, in an article on understanding how instructed and instructing counsels must work together to strengthen litigation offence and defence. The article quotes Prof Tang, who teaches at the SMU Yong Pung How School of Law and is also a consultant to TSMP.
Prof Tang talked about the challenge in crafting a clear and persuasive argument around why the client should win, and from the perspective of an appellate judge, why he/she should take this case seriously. He said hefound it much more difficult to convince a judge than to convince a student why this party should win, from the perspective of the facts and the law. Unlike classroom teaching, he noted that court debates must be simplified; the simpler, the more powerful.
Prof Tang specialises in the areas of property law, equity and trusts, unjust enrichment law and charity law, and these cases often involve complex legal and factual issues. Most of the time, he provides professional advice to the legal team, and whether he appears in court depends on the lead attorney and client needs.
The article mentioned that Prof Tang was once the appointed lawyer for the charitable organisation NUH Funds Limited. He interpreted the terms of the will and successfully won back the S$8 million real estate bequest.
Prof Tang also shared his strategy and style with the journalist. He said the decision-making power of the case lies in the hands of the client, so he will not participate in negotiations on behalf of the client and will mainly be responsible for court defence. Further, he usually does not communicate directly with clients but conducts everything through the lead lawyer to save costs and focus on legal issues.
