Thio Shen Yi, SC quoted in Tech in Asia: “Shopee’s rivals cry foul over its aggressive tactics to win sellers”
On 22 April 2021, TSMP Law Corporation joint managing partner Thio Shen Yi, SC was quoted in an article published by Tech in Asia.
But exclusivity contracts and deals can run the risk of being in breach of abuse of dominance provisions found in most Southeast Asian jurisdictions, he said.
He adds “Discount or incentive schemes, which are triggered if a certain volume or level of business is transacted with the dominant player, may not on the face be exclusive but in economic reality are”.
